Terms and Conditions
§ 1 Basic Provisions
(1) The following terms and conditions apply to contracts concluded with us as the seller (Mehmet Yaman) via the website www.wagswood.com. Unless otherwise agreed, any terms and conditions of your own that may be used are expressly rejected.
(2) A consumer within the meaning of the following provisions is any natural person who concludes a legal transaction for purposes that cannot be attributed primarily to their commercial or independent professional activity. A business customer is any natural or legal person or a legally responsible partnership that acts in the course of their commercial or self-employed professional activity when entering into a legal transaction.
§ 2 Conclusion of the Contract
(1) The subject of the contract is the sale of goods.
Our online product presentations are non-binding and do not constitute a legally binding offer to conclude a contract.
(2) You can submit a binding purchase offer (order) via our online shopping cart system.
The goods intended for purchase are placed in the "shopping cart." You can access the shopping cart via the corresponding button in the navigation bar and make changes at any time. After clicking the “Checkout” or “Proceed to Order” button (or similarly labeled), and entering your personal data and selecting payment and shipping conditions, the order details will be displayed again as an order overview.
Before submitting the order, you have the opportunity to review and change all order details or cancel the purchase.
By submitting the order via the relevant button (“place binding order,” “buy now,” “complete purchase,” or similar), you make a binding offer to us.
You will first receive an automatic confirmation by email acknowledging receipt of your order. This does not yet constitute a contract.
(3) The offer is accepted (and thus the contract concluded) within 2 days by confirmation in text form (e.g., via email), confirming either the execution of the order or the shipment of the goods (order confirmation).
If you do not receive such a confirmation, you are no longer bound by your order. Any payments made will be refunded immediately in this case.
(4) Order processing and communication of all necessary contract-related information are carried out by email, partly in an automated manner. You must ensure that the email address you provide is correct and that the receipt of emails is technically ensured, especially not blocked by spam filters.
§ 3 Special Agreements Regarding Payment Methods
(1) Payment via "PayPal" / "PayPal Checkout"
If you select a payment method offered through "PayPal" or "PayPal Checkout," the payment will be processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. The available payment methods are displayed on our website and during the ordering process. PayPal may use third-party payment providers; if specific terms apply to those, you will be informed separately.

(2) Payment via "Mollie"
If you select a payment method offered through "Mollie," the payment is processed by Mollie B.V., Keizersgracht 313, 1016 EE Amsterdam, Netherlands. The available Mollie payment options are shown on our website and during checkout. Mollie may use additional payment services; if special conditions apply, you will be informed accordingly.

§ 4 Right of Retention, Retention of Title
(1) You may only exercise a right of retention if it relates to claims from the same contractual relationship.
(2) The goods remain our property until the full purchase price has been paid.
§ 5 Warranty
(1) Statutory warranty rights apply.
(2) As a consumer, we kindly ask you to check the goods upon delivery for completeness, obvious defects, and transport damage, and to inform us and the carrier of any complaints as soon as possible. Failure to do so will not affect your statutory warranty claims.
(3) If any characteristic of the goods deviates from the objective requirements, this shall only be deemed agreed if you were informed of the deviation prior to concluding the contract and it was expressly agreed separately between the parties.
§ 6 Choice of Law
(1) German law shall apply. For consumers, this choice of law only applies to the extent that it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.
(2) The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) are expressly excluded.

3. Contract Language and Storage
3.1. The contract language is German.
3.2. The complete contract text is not stored by us. Before submitting the order via the online shopping cart system, you can print or save the contract data using your browser’s print function. After the order has been placed, you will receive the order data, legally required information for distance contracts, and our terms and conditions by email.
4. Key Features of the Goods or Services
The essential characteristics of the goods and/or services can be found in each respective product description.
5. Prices and Payment Terms
5.1. The prices listed in the respective offers as well as shipping costs represent total prices. They include all price components including applicable taxes.
5.2. Shipping costs are not included in the purchase price. They are displayed separately on our website or during checkout and are to be paid by you, unless free shipping is offered.
5.3. If delivery is made to countries outside the European Union, additional costs may apply (e.g., customs, taxes, or bank charges), which we are not responsible for and which are to be borne by you.
5.4. If the delivery is within an EU country but the payment is made from outside the EU, any bank transfer fees or currency conversion fees are also your responsibility.
5.5. Available payment methods are displayed on our website and during the ordering process.
5.6. Unless otherwise stated, payments are due immediately upon contract conclusion.
6. Delivery Conditions
6.1. Delivery terms, estimated delivery times, and any delivery restrictions can be found on our website or in the respective product listing.
6.2. For consumers, the risk of accidental loss or deterioration of the goods passes to the customer only upon delivery, regardless of whether the shipment is insured. This does not apply if you have commissioned a shipping company not designated by us.
7. Statutory Warranty Rights
Warranty is governed by the section "Warranty" in our Terms and Conditions (Section I).
This English version of the Terms and Conditions and Customer Information is based on the original German legal structure. For full legal security, especially for international sales, it is recommended to have this translation reviewed by a qualified legal expert.
